The rules of the game.

The deal

These Terms are an agreement between you and [Company] Labs LLC ("Sidequest", "we", "us"). They cover the Sidequest app, our website, and anything else we offer (together, the "Service").

By creating an account or using Sidequest, you agree to these Terms and to our Privacy Policy, which explains how we handle your data. If you don't agree, don't use Sidequest.

Who can play

• You must be at least 13 to use Sidequest.
• If you're under 18 (or the age of adulthood where you live), you need your parent or guardian's permission, and they agree to these Terms for you. Parents, you're responsible for your teen's use of Sidequest.
• You can't use Sidequest if we've banned you before, or if the law where you live doesn't allow it.

Your account

• Give us real info when you sign up, including your real birthday, and keep it up to date.
• One person, one account. Don't share it, sell it, or sign in as someone else.
• Keep your sign-in codes to yourself. You're responsible for what happens on your account.
• Pick a username that isn't offensive, misleading, or someone else's name or brand. We can take back usernames that break these rules.
• Tell us right away at support@[domain] if you think someone got into your account.

You can delete your account any time in Settings, Account, Delete account.

Quests and safety

Sidequest is about getting out and doing real things, so this part matters most.

• Use good judgment. Think about your health, skills, the weather, where you are, and who you're with before doing a quest.
• Follow the law and respect people. Don't trespass, damage property, bother strangers, break school rules, or do anything illegal for a quest or a post.
• Respect privacy. Don't film or post people who didn't agree to it, especially other minors, and never in private places.
• Don't do it while driving or anywhere it's unsafe to look at your phone.
• Know your limits. If a quest involves physical activity and you have a health condition, check with a doctor first.

You're responsible for your own actions while doing quests, and you take part at your own risk. To the extent the law allows, Sidequest isn't responsible for injuries, damage or losses that happen while you do a quest.

See a quest that seems unsafe or off? Report it in the app and we'll look at it.

Community rules

Sidequest only works if it's a good place to be. Don't post, send or do any of this:

BullyingZero tolerance

Harassing, threatening, shaming, or ganging up on anyone, including in squad chats, comments and downvotes.

HateZero tolerance

Attacks on people based on race, ethnicity, religion, gender, sexual orientation, disability or similar traits.

Sexual contentZero tolerance

Nudity, sexual content, or anything sexual involving minors. We report child exploitation to the authorities.

Violence and dangerNot allowed

Violence, self-harm, weapons, drugs, drinking, or dangerous stunts, and anything encouraging others to do them.

Faking itNot allowed

Pretending to be someone else, fake accounts, bots, posting other people's photos as your proof, or gaming XP and votes with extra accounts.

Spam and scamsNot allowed

Ads, spam, scams, selling stuff, or collecting other people's info.

Breaking thingsNot allowed

Hacking, scraping, reverse engineering, overloading our servers, or getting around blocks, bans or safety features.

Breaking the lawNot allowed

Anything illegal, or that infringes someone's copyright, trademark, privacy or other rights.

Your content

Your photos, videos, captions, comments, messages and quest packs are your content. You own it.

To run Sidequest, we need permission to use it. So you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, resize, display and share your content, only to operate, improve and protect the Service and to show it to the people you've shared it with. This license ends when you delete the content or your account, except for copies kept for a short time in backups or where the law requires us to keep them.

We won't use your proof photos or videos in ads or marketing without asking you first.

You promise that you have the rights to what you post, and that everyone clearly shown in it is okay with it being posted. We don't review everything before it goes up, but we can remove content that breaks these Terms.

XP and game stuff

XP, levels, streaks, shields, rerolls, upvotes, traits and anything similar in the app are just part of the game.

• They have no real-world value and aren't your property.
• You can't sell, trade or transfer them, or exchange them for money.
• We can adjust, reset or remove them, for example to fix a bug, rebalance the game, or deal with cheating.

Quest packs and AI

You can make your own quest packs and share them with friends. Packs follow the same community rules as everything else, and you're responsible for what's in yours.

If you use AI to draft a pack, the AI can get things wrong or suggest things that don't fit. Read every quest before you share it, and edit or delete anything that's unsafe. AI-drafted quests aren't advice and aren't checked by us before you see them.

Our stuff

The Sidequest app, name, logo, design, quest bank, characters and everything else we made belong to us or our licensors. We give you a personal, limited, non-transferable, revocable license to use the app for your own non-commercial fun, as long as you follow these Terms. Please don't copy, sell or build on our stuff without written permission.

Got an idea or feedback? We love it. Just know we can use it without paying you or owing you anything.

Reports and enforcement

You can report posts, comments, messages, quests and people in the app, and block or mute anyone. We review reports and may remove content, limit features, suspend accounts, or ban people, depending on how serious things are. For serious stuff, like threats or harm to minors, we may contact the authorities.

We can suspend or close accounts that break these Terms, put others at risk, or create legal trouble for us. If we close your account and you think we got it wrong, email support@[domain].

Changes to Sidequest

Sidequest is new and always changing. We may add, change or remove features, and we may stop offering the Service. If we shut down for good, we'll try to give you notice and a chance to save your stuff.

Sidequest is free right now. If we add paid features later, like a battle pass, we'll tell you the price and any extra terms before you pay. Purchases through the App Store also follow Apple's rules.

The legal part

No warranties

Sidequest is provided "as is" and "as available." To the fullest extent the law allows, we don't make promises about the Service, including that it will always work, be error-free, or be safe for any particular quest, and we disclaim implied warranties like merchantability, fitness for a particular purpose and non-infringement. We're not responsible for what other users post or do.

Limits on our liability

To the fullest extent the law allows, Sidequest and its team won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the Service or any quest. Our total liability for any claim is limited to the greater of $100 or what you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.

Indemnity

If someone brings a claim against us because of your content, your actions while doing a quest, or your breaking these Terms or the law, you agree to cover our reasonable costs and losses from it, to the extent the law allows.

Disputes

Talk to us first. If you have a problem with Sidequest, email support@[domain] and give us 60 days to try to fix it.

Arbitration. If we can't work it out, you and Sidequest agree to settle disputes through binding individual arbitration under the rules of the American Arbitration Association, instead of in court. Either of us can still bring a claim in small claims court, or ask a court to stop someone from infringing intellectual property.

No class actions. Claims can only be brought individually, not as part of a class or group action. You and Sidequest both give up the right to a jury trial.

Opting out. You can opt out of arbitration by emailing support@[domain] within 30 days of first agreeing to these Terms.

Governing law. These Terms are governed by the laws of the State of [State], without regard to conflict of law rules. Anything not handled by arbitration goes to the state or federal courts in [County, State]. If you live in the EU, UK or another place whose consumer laws give you more protection, those protections still apply.

Apple

If you got Sidequest from the Apple App Store:

• These Terms are between you and Sidequest, not Apple. Apple isn't responsible for the app or its content.
• Apple has no duty to provide support or maintenance for the app.
• Apple isn't responsible for any warranty claims, product liability claims, legal or regulatory claims, or intellectual property claims about the app. If the app fails a warranty that applies, you can let Apple know and they may refund the purchase price (if any), and that's the end of Apple's warranty duties.
• You confirm you're not in a country under a US government embargo and not on a US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and can enforce them against you.
• You also have to follow the App Store's own terms when using the app.

Everything else

• Changes to these Terms. We may update these Terms. We'll change the date at the top, and for big changes we'll tell you in the app or by email before they kick in. If you keep using Sidequest after that, you're agreeing to the new Terms.
• The whole agreement. These Terms and the Privacy Policy are the full agreement between you and us about Sidequest.
• If part doesn't hold up, the rest of the Terms still apply.
• If we don't enforce something right away, we haven't given up the right to later.
• Transfers. You can't transfer these Terms to anyone else. We can, for example if Sidequest is merged or sold.
• Things we can't control, like outages, natural disasters or internet problems, aren't our fault.
